  • the categories of personal data that DMC Law, LLC (“DMC Law,” “we,” “our,” or “us”) collects when you interact with our Website www.dmclawllc.com (the “Website”) or when businesses engage DMC Law to perform legal services (“Legal Services”);
  • the purposes for which we process personal data;
  • the categories of personal data we share with third parties and the categories of those third parties;
  • your consumer rights under applicable privacy laws, including the Connecticut Data Privacy Act (“CTDPA”); and
  • other important information about our privacy and data security practices.

Definitions

  • Biometric Data: Data generated by automatic measurements of an individual’s biological characteristics such as a fingerprint, voiceprint, eye retinas, irises or other unique biological characteristics that are used to identify a specific individual.
  • Consumer: “Consumer” means an individual who is a resident of this state. It does not include someone acting in a business or employment capacity, or in their role as an employee, owner, director, officer, or contractor of a business entity, nonprofit, or government agency, when their interactions with a controller occur solely as part of that role.
  • Personal data or Personal Information: Any information that is linked or reasonably linkable to an identified or identifiable individual but does not include de-identified data or publicly available information.

1. Summary of Personal Data We Collect

A. Personal Data Collected Through Our Website

DMC Law does NOT sell personal data and does NOT use personal data for targeted advertising.

B. Personal Data Collected while Providing Legal Services

When DMC Law provides Legal Services or compliance support to clients, we may receive and process additional categories of information necessary to perform those services for the client.  DMC Law is a business associate or business associate subcontractor under the Health Insurance Portability and Accountability Act (“HIPAA”) to many of its clients.  When acting in that capacity, HIPAA’s rules govern the use and disclosure of personal information that also qualifies as Protected Health Information (“PHI”) under HIPAA.

Most of the information we receive while providing Legal Services is processed on behalf of our clients and may be subject to additional legal privilege, professional confidentiality obligations, and/or applicable federal and state privacy laws. 

* Clients are discouraged from submitting Social Security numbers or other sensitive personal information to DMC Law unless necessary to provide Legal Services.

3. Categories of Personal Data and Purposes for Processing

We process the following categories of personal data though the Website or for Legal Services for the purposes described below.

A. Contact Information (Website)

This may include:

  • name
  • email address
  • telephone number

We collect this information when you voluntarily provide it, such as when you complete a contact form on the Website. 

We use this information to respond to:

  • respond to inquiries or communications
  • provide requested information or legal resources
  • deliver newsletters or other updates if requested
  • provide Legal Services where an attorney-client relationship has been established

Also, DMC Law collects demographic information for the provision of Legal Services from individuals authorized to act on behalf of the client for business purposes.

B. Website Activity Information

We may collect certain technical data automatically when you visit the Website, including:

  • browser type
  • Internet Protocol (IP) address
  • pages visited
  • time spent on pages
  • referring website addresses.

This information helps us:

  • maintain and improve Website functionality 
  • monitor Website performance
  • diagnose technical issues
  • understand how visitors use the Website

C. Cookies and Analytics Data

We use Google Analytics to understand Website usage and performance. We may also use cookies to collect information about your visit to determine which of our areas, features and pages are most popular and improve your experience on our Website.

Cookies are small text files stored on your device that allow us to:

  • analyze Website traffic
  • improve Website functionality
  • understand user engagement.

You may disable cookies through your browser settings, although doing so may limit certain Website features. 

4. Sensitive Data

Under Connecticut law, sensitive data may include information such as:

  • reproductive or sexual health data
  • gender-affirming health data
  • biometric or genetic data
  • government-issued identification numbers (SSNs, driver’s license, etc.)
  • financial account access credentials
  • data revealing racial or ethnic origin, religious beliefs, or similar characteristics.

DMC Law does not intentionally collect or process sensitive data through the Website. DMC Law instructs all website users not to provide such information to us through the Website.  

All sensitive data collected while providing Legal Services is either collected from a controller authorized to disclose such information or collected with consent. When DMC Law acts as a business associate under HIPAA, sensitive data that is collected from clients is governed by HIPAA, not the CTDPA.

5. Artificial Intelligence and Automated Processing

A. Large Language Models (LLMs)

DMC Law does not use personal data collected through the Website or for providing Legal Services to train LLMs or other artificial intelligence systems.

B. Profiling and Automated Decision-Making

DMC Law does not process personal data for profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning consumers.

6. Targeted Advertising and Sale of Personal Data

DMC Law does not:

  • sell personal data, or
  • process personal data for targeted advertising.

7. Disclosure of Personal Data to Third Parties

We may disclose personal data to the following categories of third parties:

A. Service Providers

We may share personal data with vendors that provide services on our behalf, including:

  • email marketing providers if you subscribe to our newsletter or consent to receiving our newsletter
  • Website analytics providers (such as Google Analytics)
  • learning management system providers (educational platforms, if you sign up)
  • practice management platforms for Legal Services.

B. Legal Compliance

We will only disclose personal data:

  • to comply with legal obligations
  • to respond to subpoenas or legal process as required by law
  • to protect our rights or the safety of others as permitted by law.

C. Business Transactions

Personal data may be transferred as part of a corporate transaction such as a merger or sale of assets.

8. Consumer Rights Under the Connecticut Data Privacy Act

When the CTDPA applies to DMC Law, consumers may have the following rights under applicable privacy laws:

A. Right to Confirm and Access

You may confirm whether we process your personal data and request access to that data.

B. Right to Correct

You may request that we correct inaccuracies in the personal data we hold about you.

C. Right to Delete

You may request deletion of personal data we have collected from you, subject to certain legal exceptions.

D. Right to Data Portability

You may request a copy of your personal data in a portable format.

E. Right to Access Inferences

Consumers may request access to inferences derived from personal data processed about them. 

F. Right to Opt Out

Generally, consumers may opt out of:

  • the sale of personal data
  • targeted advertising
  • profiling in furtherance of automated decisions with legal or similarly significant effects.

DMC Law does not engage in these activities. 

G. Right to Designate an Authorized Agent

Consumers may designate another person to serve as your authorized agent and act on your behalf and opt out of processing for targeted advertising, the sale of your data, and profiling as listed above.

9. Exercising Your Rights

To submit a request to exercise your rights, contact: privacy@dmclawllc.com.

We are required to respond without undue delay but within 45 days of receipt of your request. Depending on factors such as the type and complexity of the request, we may extend the time for response once by 45 additional days, as long as we notify you within the original 45 days.

We may take reasonable steps to verify your identity before responding to your request. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purpose of verification.

We are not required to make a data access or portability disclosure if we cannot verify that the requester is the individual whose data was collected or is authorized to act on that individual’s behalf.

Please note that you may only make a CTDPA-related data access or data portability disclosure request once within a 12-month period.

10. Appeals

If we deny your request, you may appeal the decision by contacting us at: privacy@dmclawllc.com

We will respond to appeals within the time period required by applicable law.

11. Data Retention

We retain personal data only as long as necessary for:

  • legitimate business purposes
  • legal compliance
  • dispute resolution
  • enforcement of agreements.

12. Information Security

We maintain administrative, technical, and physical safeguards designed to protect personal data from unauthorized access, disclosure, or misuse.

13. Children’s Privacy

Our Website is not directed at children under eighteen (18), and we do not knowingly collect personal data from children.

If we become aware that personal data from a child has been submitted, we will delete it as soon as reasonably possible.

14. Links to Third-Party Websites

Our Website may contain links to third-party Websites or services. Those third parties maintain their own privacy practices and policies.

We encourage you to review the privacy policies of any third-party service you use.

16. Changes to This Privacy Notice

We may update this Privacy Notice periodically.

If we make material changes, we will:

  • update the “Last Updated” date above, and
  • provide notice as required by applicable law.

If a material change applies retroactively to previously collected personal data, we will notify affected consumers and provide an opportunity to withdraw consent where required.

17. Privacy Protection Policy for Social Security Numbers (CGS § 42-471)

As a general matter, we treat all information we receive from clients as confidential and protect it as such.  We collect Social Security Numbers (“SSN”) from clients only when it is necessary to perform legal services on their behalf.  Additionally, we keep records of employees’ SSN, as required by law.  We safeguard SSN by protecting the confidentiality of, prohibiting unlawful disclosure of and limiting access to SSN as described below. When Social Security numbers are no longer required, they are securely destroyed in a manner that renders them unreadable and incapable of reconstruction.

Except as authorized by law and by the client, we do not disclose SSN of current or former clients or employees; or SSN of patients or employees of clients that we obtain in the course of representing our clients.  Any disclosure authorized by a client must be consistent with applicable laws, the provisions of the codes of professional responsibility and rules of ethics governing our conduct as lawyers. Additionally, we limit access to sensitive information such as SSNs to those who require access to carry out necessary job functions.

Access to SSN of employees is strictly limited to employees with a business need to access such information. Employees with access to employee SSN may not disseminate SSN internally or externally, except to fulfill a necessary business function such as performing payroll or employee benefit functions, or to comply with a court order, service of process, or other applicable law. We train all staff annually on the importance of the protection of client information and, in particular, of sensitive personal information such as SSN.

DMC Law may investigate complaints and reported violations of these Terms. If we suspect illegal or inappropriate activity, we may report it to law enforcement officials, regulators, or other parties. We may disclose user information of anyone or any entity involved in that activity to the extent necessary, including, but not limited to: user profiles, e-mail addresses, usage history, submitted or uploaded materials, IP addresses, and traffic information. If possible, we will take reasonable steps to minimize the disclosure of confidential information of users who are not the target of the investigations, such as by redacting confidential information.

You must not use this Website in any way that would be considered illegal under the laws of any state, federal or international law that applies to your use of this Website.  Further, you must not use this Website to threaten, abuse, harass or harm anyone in anyway; you must not misrepresent your affiliation with a person or agency or impersonate a person or agency, including DMC Law or its staff; you must not upload content that infringes on the rights of others and you must not store any data on the Website.

DMC Law’s Ownership Rights

This Website is protected by copyrights, trademarks and other proprietary rights and laws. DMC Law alone owns its copyrights to this Website’s content (including blog posts), layout, graphics, navigation design, source code, the collective and compiled copyrights in its databases, and all other content created by DMC Law employees, contractors, consultants, and contributors to this Website.

Indemnification

You agree to indemnify and hold harmless DMC Law and any third-party providing content to this Website, from any and all claims, losses, expenses, damages and costs, including but not limited to reasonable attorneys’ fees, arising as a result of your use of this Website.

Enforcing DMC Law’s Rights

When you use this Website, you agree that any use that violates these Terms may cause irreparable injury to DMC Law. If you do not follow these terms, you agree that DMC Law will:

  • Have the right to non-monetary relief, including a court order requiring you to stop or to perform any relief a court may impose, and
  • Not have to post any bond or other security.

Third Party Rights

DMC Law and any contributor or other third-party submitting materials to the Website have the right to enforce this agreement’s provisions with regard to Disclaimer, Liability, and Indemnification against you on its own behalf.

Severability

If any part of these Terms is found invalid or unenforceable, DMC Law and you agree that:

  • All other parts of this agreement are valid,
  • The intended meaning of the invalidated part will be replaced with language that closely matches DMC Law’s original intent, and
  • This agreement remains valid.

Even if a term of this agreement goes unenforced, DMC Law does not waive any part of this agreement, unless it does so in writing.

Notification of Alleged Copyright Infringement

DMC Law reserves the right to remove any content that allegedly infringes a third party’s copyright or otherwise violates the rights of any third party, or for any reason whatsoever, and to prohibit further use of the Website by the individuals responsible for said infringement or violation. DMC Law also reserves the right to pursue any party that submits an erroneous declaration. If you believe that any content appears on this Website in violation of your copyright or other proprietary rights, you should send a notice to DMC Law by first-class mail, return receipt requested, at the following address: DMC Law, LLC, P.O.   • Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

Integration

The version of these Terms, currently available on the Website, incorporating by reference any supplemental rules, terms or policies posted on this Website, constitutes the complete statement of the agreement between you and DMC Law for your use of the Website.

Modification to Terms of Use

Updated versions of the Terms of Use will appear on this Website and are effective immediately. Your continued use of this Website after any update constitutes your agreement to be bound by the updated Terms of Use. You are responsible for regularly reviewing the Terms of Use.
